Terms of Service
Last updated: 24 July 2026
1. About these terms
These Terms of Service govern your access to and use of MunchAlong, including its website, applications, features and services.
MunchAlong is owned and operated by OCTOPUS BOO LLC, a Montana limited liability company in the United States.
By creating an account or using MunchAlong, you agree to these Terms.
If you do not agree, do not use MunchAlong.
2. Age requirement
You must be at least 18 years old.
By creating an account, you confirm that you meet this requirement.
We may restrict or close an account when we reasonably believe the user is under 18 or supplied false age information.
3. Your account
You must provide accurate information and keep your login credentials secure.
You may not:
- Share your account.
- Create an account for another person without lawful authority.
- Impersonate another person.
- Use multiple accounts to evade limits, restrictions or bans.
- Access another person's account without permission.
You are responsible for activity performed through your account.
4. What MunchAlong provides
MunchAlong provides a technology platform through which adult users create and join small gatherings at public food and drink venues.
MunchAlong does not organise, supervise or attend Munches.
A Host is another user, not an employee, contractor, partner or representative of MunchAlong.
5. Hosts and guests
A Host creates the Munch and selects its details.
A Guest joins while a place remains available.
A Munch may have no more than four people in total, including the Host.
Hosts and Guests remain independent adults responsible for their own decisions and behaviour.
6. Public venues
Every Munch must take place at the public food or drink venue shown in the listing.
Private homes, hotel rooms, vehicles and isolated or other non-public locations are prohibited.
7. No venue relationship
MunchAlong does not own, operate, control, endorse or represent venues shown on the platform unless expressly stated.
MunchAlong does not guarantee:
- Opening hours.
- Seating.
- Reservations.
- Accessibility.
- Food or drink quality.
- Pricing.
- Service.
- Staff conduct.
- Venue safety.
- Continued availability.
Users remain responsible for checking venue details and complying with venue rules.
8. No background checks or identity verification
MunchAlong does not conduct criminal, financial, employment, address or other background checks.
MunchAlong does not currently verify users through government-issued identity documents.
Profile details, photos, account age and successful-Munch counts are not guarantees of identity, character, safety or future behaviour.
9. Meeting strangers and assumption of risk
MunchAlong helps users meet people they may not know.
Meeting strangers involves risks, including personal, physical, emotional, financial and property risks.
You decide whether to create, join, attend, remain at or leave a Munch.
To the extent permitted by law, you accept the ordinary risks associated with voluntarily meeting other users.
Nothing in these Terms removes rights or protections that cannot lawfully be excluded.
10. User conduct
You must follow:
- These Terms.
- The Community Rules.
- The Safety guidance.
- Applicable law.
- Venue rules.
Harassment, discrimination, threats, impersonation, fraud, illegal conduct and misuse of safety tools are prohibited.
11. Attendance and cancellation
When you host or join, other users may rely on your commitment.
You should attend on time or cancel responsibly.
MunchAlong may record successful attendance, no-shows and late cancellations.
Repeated or serious conduct may lead to restriction, suspension or a ban.
12. Payments between Munchers
A Host selects one of the available payment arrangements.
MunchAlong does not collect, hold, divide, transfer, process or enforce payments between Munchers.
MunchAlong is not responsible when a user:
- Refuses to pay.
- Fails to honour a “Host pays” arrangement.
- Orders more than expected.
- Leaves without paying.
- Disputes the bill.
- Causes a venue loss.
Each participant remains responsible for their purchases and conduct.
13. Premium membership
Premium is an optional paid subscription.
Current packages, prices, durations and benefits appear on the Premium page.
Premium subscription payments are processed through Stripe.
Unless stated otherwise, Premium renews automatically at the end of the paid billing period until future renewal is cancelled.
You may cancel future renewal through the available MunchAlong or Stripe billing tools.
Cancellation prevents a future renewal charge. It does not ordinarily refund the current paid period.
Your Premium benefits normally remain active until the paid period ends.
The separate Billing, Cancellations & Refunds page forms part of these Terms.
14. Refunds
Premium payments are non-refundable after successful processing, except where:
- A refund is required by applicable law.
- MunchAlong approves a refund in its sole discretion.
- A duplicate or clear technical billing error is confirmed.
No prorated refund is provided merely because you stop using Premium or cancel before the paid period ends.
15. Content you provide
You retain ownership of content you submit, such as your profile photo, introduction, invitation text and feedback.
You give MunchAlong a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and process that content only as needed to operate, secure and improve the platform.
You must have the right to submit the content.
Do not submit unlawful, infringing, deceptive or harmful material.
16. Private feedback
Feedback is intended for internal attendance, safety, moderation and platform analysis.
It is not a public rating system.
MunchAlong may disclose information where required by law or when responding to a valid data-rights request, while taking reasonable steps to protect another user's identity and safety where lawful.
17. Safety and moderation
MunchAlong may investigate conduct and take action to protect users or the platform.
Action may include:
- Warning.
- Removal from a Munch.
- Cancellation.
- Temporary restrictions.
- Suspension.
- Permanent ban.
- Temporary Separation.
- Content removal.
- Record preservation.
- Contact with authorities where appropriate or legally required.
MunchAlong may act based on the information reasonably available at the time.
18. Temporary separation
Following a safety concern or moderation action, MunchAlong may prevent users from seeing or joining each other's Munches.
MunchAlong may apply this measure without disclosing the existence, reason or duration of the separation to either user.
19. Account deletion
When you request account deletion, MunchAlong may:
- Cancel future Munches you host.
- Remove you from future Munches you joined.
- Notify affected participants.
- Release occupied places.
- End your active session.
- Remove or anonymise identifying profile information.
Account deletion does not necessarily erase every operational, billing, legal, security, safety or moderation record.
MunchAlong may retain or anonymise records where reasonably needed to:
- Protect users.
- Prevent abuse.
- Maintain accurate transaction or attendance records.
- Meet legal obligations.
- Establish, exercise or defend legal claims.
- Enforce restrictions and bans.
20. Third-party services
MunchAlong relies on third-party services, including Base44, Stripe and Google Maps or Places.
Those services may have separate terms and privacy practices.
MunchAlong is not responsible for third-party outages, service changes or independent conduct.
21. Platform availability
MunchAlong may change, suspend, restrict or discontinue part or all of the platform.
We do not guarantee uninterrupted, error-free or permanently available service.
22. Intellectual property
The MunchAlong name, logo, branding, software, interface, page design, written content and platform materials are owned by or licensed to OCTOPUS BOO LLC.
You may not copy, reproduce, modify, sell, licence, impersonate or exploit those materials without written permission, except where law permits.
23. Disclaimers
To the extent permitted by law, MunchAlong is provided on an “as available” basis.
MunchAlong does not guarantee:
- The identity or conduct of a user.
- Attendance.
- Compatibility.
- Friendship or any personal outcome.
- Venue service or availability.
- Payment between Munchers.
- Accuracy of every user-supplied statement.
- Complete prevention of abuse or unsafe conduct.
24. Limitation of liability
To the extent permitted by law, OCTOPUS BOO LLC and its owners, officers, employees, contractors and service providers are not liable for indirect, incidental, special, exemplary or consequential loss arising from use of MunchAlong.
This includes loss connected to:
- Another user's conduct.
- A no-show.
- A payment dispute between Munchers.
- Venue conduct or conditions.
- Travel.
- Personal injury.
- Property damage.
- Lost opportunities.
- Data loss.
- Platform interruption.
Where liability cannot be excluded, it is limited to the amount you paid directly to MunchAlong during the 12 months before the event giving rise to the claim, or 100 US dollars if you paid nothing, unless applicable law requires a different result.
25. Your responsibility to MunchAlong
If your unlawful conduct, intentional misconduct or breach of these Terms causes a third-party claim against MunchAlong, you agree to be responsible for the reasonable losses and costs caused by that conduct, to the extent permitted by law.
26. Changes to these terms
We may update these Terms to reflect product, legal, safety or operational changes.
The updated Terms will be published with a revised date.
Where required, we may request renewed acceptance.
27. Governing law
These Terms are governed by the laws of the State of Montana, United States, without regard to conflict-of-law principles.
